The Eroding Value of Workers Compensation Benefit Cap Levels (pdf) This September 2008 update to the original 2006 report (see below) addresses the effect of inflation on the value of workers compensation benefits in Kansas as of July 2008. No Litigation Crisis Fact Sheet(pdf) 2006 LEGISLATIVE SESSION This 2006 report addresses the effect of price inflation on the purchasing power of workers compensation benefits in Kansas. It concludes that the total workers compensation benefits injured workers can receive have lagged far behind average wage changes for Kansas workers. The study examines the dollar limits that were established in 1987, 1993 and 2000 and poses the question, "What would benefit caps look like today if they had grown by the same rate as Kansas average wages per employee?" See updated report above. 2005 LEGISLATIVE SESSION This report by Jay Angoff, former insurance commissioner for the state of Missouri, examines the workers compensation insurance system in Kansas, which has produced high profits for insurance companies and low rates for employers but "extremely limited" benefits for injured workers. Angoff proposes restructuring the residual market in a way that would make it possible to raise benefits for injured workers while retaining the low rates enjoyed by Kansas employers. 2004 LEGISLATIVE SESSION |
